Varanasi Property Registry & Stamp Duty Guide (2026)
When people budget for a property in Varanasi, most think only about the price they’ve negotiated. But registry costs — stamp duty plus registration fee — add roughly 8% on top for most buyers, and that money is due upfront, in full, before the property becomes legally yours. On a ₹50 lakh duplex, that’s around ₹4 lakh you need ready beyond the purchase price.
Here’s how it actually works in 2026. One note before we start: rates are set by the Uttar Pradesh government and do change — everything below is accurate as of July 2026, but confirm the current figures on igrsup.gov.in (the official UP Stamp & Registration portal) before you pay anything.
What are the stamp duty and registration charges in UP in 2026?
As of mid-2026, for property in Varanasi (rates are state-wide across Uttar Pradesh):
- Male buyer: 7% stamp duty
- Female buyer (sole ownership): 6% stamp duty, on properties valued up to ₹1 crore
- Joint male + female: 6.5% is commonly applied — confirm your exact case at the sub-registrar office
- Registration fee: 1% of the property value, for everyone
So a man buying a ₹50 lakh house pays ₹3.5 lakh stamp duty + ₹50,000 registration = ₹4 lakh. The same house registered in his wife’s name: ₹3 lakh + ₹50,000 = ₹3.5 lakh — a straight ₹50,000 saving.
The women’s concession got much bigger recently. Until 2025, the 1% rebate for women applied only to properties worth up to ₹10 lakh — a maximum benefit of ₹10,000, which meant almost nothing in a real transaction. In July 2025 the UP Cabinet extended it to properties worth up to ₹1 crore, so the maximum saving is now ₹1 lakh. If you’re a family deciding whose name goes on the deed, this is worth real money.
Duty is charged on the circle rate or your price — whichever is higher
Stamp duty isn’t simply a percentage of what you paid. Every locality in Varanasi has a government-notified minimum valuation — the circle rate (also called DM circle rate or सर्किल रेट) — and duty is calculated on your transaction value or the circle-rate value, whichever is higher.
Two things follow from this:
- You can’t reduce stamp duty by under-declaring the price. If the circle-rate valuation of the property is ₹45 lakh, you pay duty on at least ₹45 lakh even if the deed says ₹35 lakh.
- Check the circle rate for your specific area before budgeting. Varanasi’s circle rates were revised upward (effective August 2025) in many areas, with some localities seeing significant hikes. The official rate lists are published SRO-wise on igrsup.gov.in under the मूल्यांकन सूची (valuation list) section — select Varanasi as the district, then your sub-registrar office.
We deliberately aren’t quoting per-square-foot circle rates here, because they vary lane by lane within the same locality and third-party figures floating around online are often stale. How does property registration actually work in Varanasi?
The process runs through the sub-registrar office (SRO) for your area, with the paperwork initiated online:
- Get the sale deed drafted. Usually done by a deed writer or lawyer. It records the parties, the property description and boundaries, the price, and the terms.
- Apply online on igrsup.gov.in. The property registration application (“आवेदन करें” under संपत्ति पंजीकरण) captures the deed details, calculates the duty based on the higher of price and circle-rate valuation, and generates the payment.
- Pay stamp duty and registration fee online. UP uses e-stamping — you pay through the portal and the payment is tied to your application. Keep the receipt.
- Book an appointment at the sub-registrar office. Buyer, seller, and two witnesses must appear in person with original ID (Aadhaar/PAN), photographs, and the deed.
- Biometrics and signing at the SRO. Photos and fingerprints of both parties are captured, the deed is signed and registered.
- Collect the registered deed. Once registered, you are the legal owner. Certified copies can be obtained from the same office or portal later if ever needed.
The whole thing, if documents are clean and the appointment is booked, is typically done in a single visit — the slow part is everything before the SRO: verifying the title, agreeing the deed text, and arranging funds.
Don’t skip these two follow-ups after registration
Mutation (dakhil kharij). Registration makes you the owner; mutation updates the municipal/revenue records to say so. Until you do it, property-tax records and government records still show the previous owner, which creates friction for everything from tax payment to your own future resale. Apply for mutation with your registered deed soon after registry — don’t leave it for “later.”
TDS if the property costs over ₹50 lakh. For transactions above ₹50 lakh, the buyer must deduct 1% TDS from the payment to the seller and deposit it with the Income Tax Department (Form 26QB). This is the buyer’s legal responsibility, not the seller’s — many first-time buyers in Varanasi learn this only after the deal.
Transferring property within the family? It’s ₹5,000, not lakhs
If property is being gifted within close family — parents, children, spouse, real brother or sister, grandchildren, son-in-law or daughter-in-law — UP charges a flat ₹5,000 stamp duty on the gift deed instead of the percentage rates above. On a ₹1 crore family property, that’s the difference between ₹5,000 and several lakh.
Two caveats: it applies to residential and agricultural property between individuals (not firms, companies, or trusts), and if the recipient gifts the property onward within five years, the concession is affected. If your situation is a family transfer rather than a purchase, take the gift-deed route through a lawyer — it’s dramatically cheaper.
The honest summary
- Budget ~8% extra over the negotiated price (7% + 1% for most buyers) — this is not optional and not negotiable at the SRO.
- If a woman in the family can be the sole owner and the property is under ₹1 crore, the effective cost drops to 7% total — up to ₹1 lakh saved.
- Duty is on the higher of your price and the circle rate — check the official rate for your lane, not a generic figure for the locality.
- Registration isn’t the end: do mutation, and handle TDS if the deal is above ₹50 lakh.
- Rates change by government order. As of July 2026 the numbers above are current — verify on igrsup.gov.in when you’re actually ready to register.
