Welcome to brixon.in ("BrixOn Properties", "we", "us"). By accessing or using this website, enquiring about any property, or contacting us, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use this website.
1. Our Role — A Listing Platform That Connects, Not a Party
BrixOn Properties is a property listing, video and enquiry platform for Varanasi — a bridge between buyers or tenants and property owners, landlords and developers. We publish listings from owners, landlords, developers and independent local partners, and we pass enquiries to them; on most properties an independent local partner helps with the visit. We do not act as the agent or broker of any buyer or tenant, we are not a party to any sale, purchase, lease or agreement, we do not own the properties we show, and we do not guarantee any deal. For certain developer projects (see Section 2A) we act as the developer's channel partner. Every negotiation, payment and agreement happens strictly and directly between the buyer or tenant and the owner, landlord or developer.
1A. Local Partners — Independent of BrixOn
Site visits, negotiations and deals are handled by the owner directly or by an independent local partner who knows that area and is named to you before your visit. Local partners are independent individuals or businesses who work with BrixOn in their area. They are not employees, agents or representatives of BrixOn Properties, they do not act on BrixOn's behalf, and BrixOn does not supervise or control how they work. Working with a partner is not an endorsement or guarantee of that partner. Each partner is solely responsible for their own conduct, statements, advice, fees and any arrangement they make with you. Neither partners nor anyone else is authorised to give legal, title or investment opinions on behalf of BrixOn Properties, to certify or guarantee any property, its ownership, its documents, its disputes or its approvals, or to collect any payment for BrixOn. All token money, advance and purchase consideration must be paid directly to the owner or developer against a receipt — never to BrixOn Properties. Any assurance, promise or representation made by a partner is the partner's own and does not bind BrixOn Properties, and BrixOn Properties is not responsible or liable for any act, omission, statement, fee or dispute of a partner. Verifying the property, its title and its approvals remains the buyer's own responsibility, as set out in Section 3.
1B. Direct-from-Owner Listings
Many listings come to us directly from owners. For these, every detail is as given and declared by the owner. BrixOn Properties does not visit, inspect or investigate these properties for title, disputes, court cases, loans, encumbrances, acquisition or demolition notices, approvals or boundaries, and even where a property has been seen or filmed, that is not a check of any of these. Owners may be asked to sign a listing declaration and to share a copy of their ownership papers, so that the buyer's own advocate can check them; the owner who signs it is solely responsible for its truth. If an owner's listing or declaration turns out to be false, incomplete or misleading, the owner alone is responsible to the buyer or tenant, and agrees to make good any loss, claim or cost this causes BrixOn Properties or its partners.
2. Property Information, Photos & What “Seen in Person” Means
All property details — price, rent, size, ownership, photographs, videos, measurements, facing, approvals, amenities and features — are provided by the owners, landlords, developers or their representatives. We present them as shared with us and do not guarantee their accuracy, completeness or timeliness. Prices, rents and availability can change, and a property may be sold, rented or withdrawn at any time without notice. BrixOn Properties does not check the title, ownership, disputes, approvals, encumbrances or legal status of any property, whether it is listed by an owner, a developer or a local partner. We or our partners often film a property before listing it. A video or photograph means only that the property was filmed as it was shown at the time. It is not a verification or certification of title, ownership, documents, approvals, area, price, construction quality or condition, and creates no warranty of any kind. Photos may be adjusted for brightness, colour and clarity. Images of projects that are not yet built are artist’s impressions and the actual property may differ.
2A. Developer Projects (such as Bliss Emporio)
For some new projects BrixOn Properties is a channel partner of the developer and may be paid a commission by the developer. That commission is paid by the developer and does not add anything to the price you pay. Everything we show about a developer project — prices, price lists, payment plans, floor plans, sizes, specifications, amenities, renders, walkthrough videos, brand names, completion dates and RERA details — comes from the developer’s own material and public sources. Brands shown in a developer’s plans or renders are illustrations and are not confirmed tenants. The developer sets and may change prices, plans, availability and specifications. The developer alone is responsible for the project: its construction, quality, approvals, completion, possession, refunds and every obligation under RERA and the agreement for sale. Check the project’s registration yourself on the UP RERA website, and make every payment only by cheque, demand draft or bank transfer into the developer’s designated RERA collection account — never in cash, never to an individual, and never to BrixOn. We do not guarantee the completion or delivery of any project, or any rent, return or rise in value.
2B. Rentals
For rental listings, the rent agreement, security deposit, rent, maintenance, repairs, use of the property and any dispute are strictly between the landlord and the tenant. Landlords are responsible for complying with the law, including police verification of tenants where it is required. Tenants should inspect the property and check the landlord’s ownership or authority to let it before paying any deposit or rent, and should always sign a written agreement. BrixOn Properties is not responsible for unpaid rent, damage, deposits, eviction or any other dispute between landlord and tenant.
2C. Commercial Property
Buyers and tenants of commercial property are responsible for checking that the property suits their intended business and for obtaining every permission it needs — including land-use and zoning, trade licence, fire safety NOC, occupancy and completion certificates, electricity load sanction and signage approvals. Information about footfall, visitors, catchment, nearby roads, projects or the growth of an area is general information and not a promise of business, footfall, rent or returns.
2D. Prices, “Negotiable” and Illustrations
Prices and rents on this website are the amounts asked by the owner, landlord or developer. “Negotiable” means the owner has said they are open to discussing the price; it is not a promise that any reduction will be agreed, and the final price is agreed between you and the owner, landlord or developer alone. A listed price is not an offer by BrixOn Properties. The animations, illustrations and example messages on this website — such as the customer-journey film on our homepage — show how the process generally works. They are not a promise of any particular price, saving, rate, outcome or timeline.
3. Buyer Responsibilities & Due Diligence
Before any payment or agreement, buyers must independently verify: ownership and title documents, government approvals and sanctioned maps, encumbrances and loans on the property, seller identity and authority to sell, and prevailing market rates. Buyers should engage their own advocate for legal verification. Buyers agree to make only genuine enquiries, to not misuse owner contact details for spam, marketing or harassment, and to behave lawfully and respectfully during site visits.
4. Owner / Seller Responsibilities
By listing with us, owners confirm that: they are the lawful owner or are legally authorised to sell the property; all information and documents provided are true and complete; the property is free from undisclosed disputes, encumbrances or claims, or that any such matters have been disclosed. Owners are solely responsible and liable for any misrepresentation, concealment or fraud in their listing or during a transaction. We reserve the right to refuse, suspend or remove any listing at any time without notice. Owners and partners who list a property may be asked to sign a listing declaration confirming these points, and the person who signs it is responsible for its contents. Owners agree to indemnify BrixOn Properties and its partners against any claim, loss or cost arising from a false, incomplete or misleading listing.
5. Fraud & Misrepresentation
If any owner defrauds or misleads a buyer, or any buyer defrauds, cheats or harms an owner, the liability rests entirely with the person committing it. BrixOn Properties is not responsible for fraud, fake documents, impersonation or misrepresentation by any user, owner or buyer. We will, however, cooperate with law-enforcement authorities and may share relevant information with them when legally required, and may permanently ban such persons from the platform.
6. Payments & Token Money
BrixOn Properties does not collect, hold or transfer any payment, token amount, advance or consideration for any property on behalf of buyers or sellers. Never hand over cash or transfer money to anyone claiming to represent us for a property purchase. Any token, advance or payment made between buyer and seller is at their own risk and should always be made against proper written documentation and receipts, preferably on legal advice.
6A. Fees, Brokerage & What Overrides This Website
Using this website is free. Any brokerage or fee for a visit or a deal is agreed between you and whoever handles that property — the owner, the local partner or, for some developer projects, BrixOn Properties — and you will be told the amount before the visit, never after you have fallen for a property. That arrangement is between you and them. BrixOn Properties may receive a fee from its partners, owners or developers when a deal is completed; that is agreed separately with them. Information published on this website may change and may differ from the final position. Listings, prices, rents, sizes, availability, tags and any fee indication shown here are for guidance only. What you finally agree with the owner, landlord, developer or local partner before you visit or enter into a transaction — including any brokerage or fee and to whom it is payable — is the final position between you and them, and it overrides anything stated on this website. Messages on WhatsApp, calls and conversations with BrixOn Properties or a partner are for arranging visits and sharing information. They are not offers, contracts or guarantees.
7. Site Visits
Site visits are facilitated as a convenience and are undertaken at your own risk. Verify the identity of the person you are meeting, prefer daytime visits, and take reasonable safety precautions. We are not liable for any incident, loss or injury occurring during site visits or meetings between parties. Before a visit you may be asked to sign a short visit acknowledgement confirming that BrixOn Properties only arranges the visit and that the checks listed in Section 3 are yours to carry out.
8. No Financial or Legal Advice
Nothing on this website is financial, legal, tax or investment advice. All content is general information only. Consult independent professionals — advocate, chartered accountant, financial advisor — before making any decision.
8A. Calculators, Estimates & Area-Growth Information
Our calculators — including the stamp duty, EMI and circle-rate calculators — and every figure they produce are estimates to give you an idea only. The final price, charges, taxes, stamp duty and instalments are the ones agreed in writing at booking, in the agreement and at the registry, under the government rates in force at that time. Information about infrastructure, government projects, tourism or the future growth of an area comes from news reports and public sources. Such projects and their timelines can change, be delayed or be cancelled, and past trends are no guarantee of future prices, rents or returns.
9. Limitation of Liability
To the maximum extent permitted by law, BrixOn Properties, its owner, team and representatives shall not be liable for any direct, indirect, incidental or consequential loss or damage arising from: use of this website; reliance on any listing, photograph, video, calculator or other information; dealings or disputes between buyers, tenants, owners, landlords or developers; any act, omission, statement or fee of an owner, landlord, developer or local partner; fake or inaccurate listings; delay, change or failure in any developer project or government project; or the cancellation or failure of any transaction. Your sole remedy for dissatisfaction with the website is to stop using it.
10. Indemnity
You agree to indemnify and hold harmless BrixOn Properties from any claim, demand, loss or expense (including legal fees) arising out of your use of the website, your listing, your transaction with another user, or your breach of these terms or of any law.
11. Intellectual Property
All website content — design, text, branding, photographs and videos — belongs to BrixOn Properties or the respective owners. Developer project brochures, renders, walkthroughs and logos belong to the developer and are shown for marketing the project. Nothing here may be copied, scraped or reused without written permission.
12. Third-Party Links
This website contains links to third-party platforms and sources (such as YouTube, WhatsApp, Google Maps, the UP RERA website and news websites). We are not responsible for their content, accuracy, policies or availability.
13. Changes & Severability
We may update these terms at any time; continued use of the website means acceptance of the updated terms. If any clause is held invalid, the remaining clauses continue in full force.
13A. Grievance Officer
If you have a complaint about a listing or about anything on this website, contact our Grievance Officer: Ravi Singh, Founder, BrixOn Properties — email [email protected], WhatsApp or call +91 98717 35093. We acknowledge complaints within 24 hours and aim to resolve them within 15 days. If a listing is reported as false or unlawful, we may suspend or remove it while we look into it.
14. Governing Law & Jurisdiction
These terms are governed by the laws of India. All disputes are subject to the exclusive jurisdiction of the courts at Varanasi, Uttar Pradesh.
