Documents Checklist for Buying a Resale Property in Varanasi

Buying resale property in India runs on paperwork, and Varanasi is no exception. This isn’t legal advice — always get a local property lawyer to verify documents before you pay anything — but here’s what to expect and ask for, so you know what a seller or agent should be able to show you.

The core documents

Sale deed (from the seller’s own purchase) — proves how the current owner acquired the property. This is the starting point for tracing ownership.

Encumbrance certificate — shows whether the property is free of loans, mortgages, or legal claims. Get one covering at least the last 13 years, ideally longer.

Mutation record (Dakhil Kharij) — confirms the property has been officially transferred into the current owner’s name in municipal/revenue records, not just on paper via the sale deed.

Property tax receipts — recent paid receipts confirm there’s no outstanding dues attached to the property, and that the address/owner details match official records.

Approved building plan / layout — for constructed properties, confirms the structure matches what was actually approved, rather than unauthorized additions.

Owner’s identity proof — confirms you’re dealing with the actual, legal owner (or someone holding valid power of attorney), not an intermediary.

No-objection certificate (NOC) — required in some cases, e.g. from a housing society or, for certain properties, other authorities.

Before you sign anything

  • Verify title through a lawyer, not just by reading documents yourself — a proper title search takes into account records you likely don’t have direct access to.
  • Match names and details across every document — the seller’s name, property address, and area/size should be consistent across the sale deed, tax receipts, and mutation record.
  • Understand stamp duty and registration charges upfront — these are a real cost on top of the purchase price, and vary by transaction value.
  • Get everything in writing in the sale agreement before the final sale deed — the price, the timeline, what’s included, and any conditions.
